Do I have to move to SBC or can I ask that SB Cares redeploys me or makes me redundant?

If an employee works in the services which are being transferred, then legally they automatically transfer to us. You can refuse to transfer but you would be resigning from your position and would not be entitled to any redundancy payment.

I have a fixed term contract. Do I transfer to SBC?

Yes, with the same end date as your current contract.

I am employed on a zero hour’s contract. Do I transfer to SBC?

Yes, on a zero hours contract.

If an SB Cares employee is transferred back to the Council do they lose their benefits/continuous service?

There is a local agreement between SB Cares and ourselves that service with one organisation will be recognised by the other.

Will we still be able to take flexible retirement at 55?

The same policies and procedures as presently exist will continue to apply so you will continue to be able to speak to a Manager of SB Cares, or a member of our HR Department.

Will our pay, hours, holidays, sick pay change?

No, your terms and conditions remain unchanged as a result of the move.

Will paydays and twice monthly travel pay change?

These will all stay the same.

Do we have to sign new contracts?

No, your existing contracts will transfer to us.

Will we be offered legal advice on new contracts?

No, because you won’t have new contracts, you will still have the same contracts.

Will set holidays remain the same?

Yes. No changes will take place to holidays.

Will there be any changes to ‘walking’ contracts for home carers?

Walking contracts don’t exist, however, we understand that a number of home care staff support clients in their local area without the use of a car and in that respect nothing will change.

Will there be any redundancies including voluntary?

There are no redundancies planned as part of the transfer.

Will the salary scale change?

No, it will stay the same.

Will there be more flexible contracts?

Contracts will stay the same.

Will travel and expenses be paid for working outside usual area?

Payment of travel and expenses will continue as per the current arrangements.

I work on a supply/ relief basis. Do I transfer to the Council?

No. Supply/relief staff are engaged as and when required to fulfil the needs of the service. They are not employees between the engagements. We will need to call on the services of relief staff after the transfer and will ask for their agreement for their details to be transferred to the Council so they can be contacted.
