Privacy notice for the Community Learning and Development service

Who we are

Scottish Borders Council is the data controller for the personal information you provide. We have our Headquarters at Newtown St Boswells, Melrose, TD6 0SA.

What information do we collect

  • Personal details: name, address, email, phone number.
  • Learning records: progress, attendance, achievements.
  • Sensitive data, if provided: e.g. health information, ethnicity, additional support needs.

Where we get your data

Most information comes directly from you. If you are referred by another organisation e.g. the Employability Service, we may receive basic details from them to support your participation.

Why we collect your data and our legal basis

  • Maintain learner records and contact you.
  • Measure progress and improve learning programmes.
  • Report to Scottish Government and Education Scotland, as required by law.
  • Lawful basis: public task (performing a function in the public interest) or legal obligation (where law requires sharing).
  • Sensitive data processed under substantial public interest provisions.

Do you have to provide your data?

Participation is voluntary. If you choose not to provide your details, we may not be able to offer full support or access to certain learning opportunities.

Who we share your data with

  • Delivery partners e.g. Borders College.
  • Specialist training providers.
  • Scottish Government and Education Scotland, where legally required.
  • Internal Council teams for service improvement, in anonymised reports.

We do not share your data for marketing purposes.

We do not transfer your data outside the UK.

How long we keep your data for

We keep your information for two years after you finish learning with the CLD Service, then securely delete it.

Your rights

You have the right to:

  • access your data
  • request correction or deletion
  • restrict or object to processing
  • withdraw consent (if consent was given).

Automated decision-making

We do not use automated decision-making or profiling. Some processes are semi-automated e.g. anti-fraud checks, but a human will always make the final decision.
