Brief overview of the variation applied for - Amendments to Operating Plan as follows:-

Q1 – Change from off sale only to both off sale and on sale
Q2 – Change on sales from nil to Sunday to Wednesday 11.00am – 12.00midnight, and Thursday to Saturday 11.00am to 1.00am
Q4 – Seasonal Variation - Change No to Yes. Add wording “During the festive period of the year, Christmas Eve, Christmas Day, Boxing Day, New Year’s Eve and New Years Day to 1.00am or within the agreed Board policy.”
Q5 – Activities - Change No to Yes in columns 2, 3 and 4 for Conference facilities, restaurant facilities, bar meals, receptions etc, club or group meetings, live performances, dance facilities, films, televised sport.
Change No to Yes in columns 2 and 3 for gaming.
Provide wording re use of Column 4 to read – These activities may occur prior to core hours but not beyond core hours without the benefit of an extended hours application.
(f) – Any other activities – The premises is the visitor centre for the Borders Distillery and as well as being the main reception area for the distillery, it will have various items for sale by retail ranging from alcohol to a variety of gift items including cashmere and tweed material and clothing. In addition to the visitor centre the premises will hold events with the retail area being used for event space. There is a bar on the first floor, a meeting room and the Mash House that will be used to host private events, weddings and whiskey tasting.
Q6 – Children and Young Persons - Access – Change to Yes
Terms add wording – “Children will be allowed throughout the premises if accompanied by a responsible adult for the purposes of having a meal, participating in a whiskey tour or attending a private event.”
Ages – add wording “Children 0-15 years, Young Persons 16-17 years”
Times – add wording “From 10.00am if attending the visitor centre shop, or 11.00am if attending the whiskey distillery until 10.00pm, or for the duration of a private event.”
Parts of the Premises – add wording “All areas apart from the immediate vicinity of the bar.”
Q7 – Capacity – Remove reference to display capacity and add wording “250 Persons”.
Objections
