- Mothers and working fathers, or the mother’s partner and:The baby’s mother has been entitled to SMP or maternity allowance, but has given it up to opt for shared parental pay; The father or partner meets the conditions for paternity pay; The mother and father or partner must still be employed by the same employer during the shared parental pay period.

- From at least 2 weeks after the birth (4 weeks if mother works in a factory)
