- Please produce every and all transcripts of recorded telephone conversations, letters and emails referring to D144/6 Crosslaw access road off School Road Coldingham from 1970 to the present day. Further produce every and all transcripts of recorded telephone conversations, letters and emails referring to the sewer which runs through the property of No1 Crosslaw for the same time period.

Please find attached correspondence held by Scottish Borders Council officers in relation to the above request.
The Council advise that all enquiries in relation to the requested address are now logged in the Council’s electronic system. Paper records are no longer retained. Furthermore, the Council advises that it does not ‘record’ telephone calls. Where information of significance is imparted in a telephone conversation, it should be recorded. This is pragmatic practice, judged on a conversation-by-conversation basis because the Council should only be recording/retaining what information is necessary for the purpose. Scottish Borders Council do not have any records of surface water drainage plans as its usually shown on Scottish water sewers and combined systems plans which have to be applied for privately from Scottish Water, therefore we advise no information is held and we apply 10(4)(a) of EI(S)R 2004. Some of the attached information has been redacted as this is third party personal information and is exempt from disclosure under Regulation 11(2) of EI(S)R 2004. Regulation 11(1) of the EI(S)R 2004 also applies to some of the redaction as this is the personal data of the applicant. This is also exempt from disclosure into the public domain.

The title deed contained within file 1 contains personal data because this is a public document.
