In relation to Q2 and 3 - As there is only one placement, the Council would consider this information commercially sensitive therefore section 33(1)(b) of FOI(S)A 2002 applies. To provide this information may prejudice the commercial interests of contractor. The release this information may give information regarding pricing policy of operators and also give unfair advantage should the information be shared.
Commercially sensitive information will typically involve any data which, if misused, could jeopardise a businesses' general commercial interests. An issue could arise if the commercially sensitive information is released to either a competitor or the general public.
We have considered the public interest test and it will always be in the public interest for the Council to obtain best value and by disclosing this information would prejudice this.
In addition, because there is only one placement this identifies how much money is spent on one individual. As such, section 38(1)(b) of FOI(S)A 2002 is also being relied on.
