As you will be aware , Police Scotland have been widely publicising their 'Hate Crime Campaign' in anticipation of the implementation of the Hate Crime and Public Disorder( Scotland ) Act 2021, and during this have highlighted the development of 'Third party Reporting Centres' in which your organisation has been listed. Please consider this an FOI request under the Freedom of Information (Scotland) Act We would be grateful if you could provide a response to the following questions; * What training has or have your organisation/employees received to carry out these tasks and who was the provider? * Who funded any training you may have received to participate in this scheme?
* How will data which your organisation collects be used/retained, specifically with reference to the Data Protection Act (2018) ?
* Is your organisation (and/or employees)expected to participate in any ongoing investigation and potential legal proceedings based on this third party reporting ?
* Has it been made clear to your organisation the process by which third party reporting, in some circumstances possibly hearsay, will be used in the case of an accused person being involved in any other 'hate' crimes, and the potential expectation of your organisation to be part of a chain of evidence?
* Have you been made aware of any procedure for dealing with potentially vexatious or malicious complaints or are you expected to complete a report regardless? * Have you been advised whether the activity you are about to participate in is considered as part of a criminal offence procedure and, if so , are you aware of any statutory levels of protection afforded to your organisation and/or employees particularly in respect of any action taken against you by aggrieved parties?
* Is your organisation being paid to participate in this scheme and if so, by whom?
* If your organisation is being paid, is this on a contractual basis or per report submitted?
* Is your organisation equipped to support your employees who may have to deal with significant emotional arousal/distress of complainants and if so, how?
* Have all employees in your organisation been given a choice in whether they participate in this scheme? - Response
