Detailed legal requirements for same sex couples wishing to register their partnership
Civil Partnership Registration in Scotland
Any two persons regardless of where they live, may form a Civil Partnership in Scotland provided the following basic requirements are met.

They must be of the same sex.

Both parties must be at least 16 years of age on the day of the Civil Partnership registration.

They must not be related to each other within any of the forbidden degrees, except in certain relationships of affinity. (Further information can be obtained from the District Registrar).

They must be free to form a Civil Partnership. If either party has already been married or has been in a previous Civil Partnership, evidence of the termination of the earlier marriage or Civil Partnership must be produced to the Registrar. Where either has already been married more than once or has been in more than one previous Civil Partnership, evidence of the termination of the most recent marriage or Civil Partnership is required.

They must be capable of understanding the nature of a Civil Partnership and of validly consenting to it's formation.
Persons who may register a Civil Partnership.
You may form a Civil Partnership in Scotland in the presence of an authorised Registrar or Assistant Registrar who has been specifically appointed by the Registrar General.
