Investigation Reports
Public bodies have a statutory obligation to publish the outcome of the SPSO's investigations about them. The SPSO Act states that bodies,
"must, unless the Ombudsman otherwise directs, make arrangements, having effect for a period of at least 3 weeks, for allowing any person to inspect the report at any reasonable time and obtain a copy of it."
When making an investigation report public, the anonymity of the complainant and anyone else in the report must be preserved. SPSO reports will name the organisation concerned, but not name or identify any individual concerned. For data protection purposes, organisations should ensure that they preserve the anonymity of complainants in any public reports, minutes of meetings, websites and other public documents.
