SECTION 11
APPEALS
Constitution1. All Members of the Council shall be Members of a Panel, from which the members of specific Appeal Committees (except for Education Appeals which are dealt with in Section XII) shall be drawn, depending on the function so referred.
Chairman
2. The Depute Leader (Human Resources) shall be the Chairman of the Appeals Panel.
Selection of Appeal Committees
3. Each of the following Appeal Committees shall be selected by the Head of Corporate Administration or his authorised representative in consultation with the Chairman of the Appeals Panel.
Appeal Committees
4. There shall be constituted the following specific Appeal Committees having the following constitutions, quorum and functions.
5. Staffing Appeals Committee
(a) This Committee shall comprise 5 Members drawn from the full Appeals Panel.
(b) The Chairman of the Panel shall chair the Committee or, in his absence, the Chairman shall be another Executive Member.
(c) 5 Members of the Committee shall constitute a quorum;
(d) The following functions shall stand referred to the Committee:-
(i) The consideration and determination of appeals by all employees against decisions in respect of discipline, gradings and conditions of service.
(ii) The consideration and determination of grievances by all employees.
6. Roads Appeals Committee
(a) This Committee shall comprise 5 Members drawn from the Appeals Panel, which Members shall include the Executive Member for Roads and Infrastructure;
(b) The Chairman of the Committee shall be the Executive Member for Roads and Infrastructure;
(c) 5 Members of the Committee shall constitute a quorum;
(d) The following functions shall stand referred to the Committee:-
The consideration of any unresolved matters arising in terms of the Roads (Scotland) Act 1984, as amended, in relation to:-
(i) The issue of Construction Consents for new roads, including objections from parties affected, appeals against conditions and recommended refusals.
(ii) The issue of Consents for the erection of scaffolding or deposit of materials or skips on a road.
(ii) Trading on or near principal roads.
7. Access to Personal Files Appeals Committee
(a) This Committee shall comprise 3 Members drawn from the Appeals Panel, which Members shall include the Executive Member for Social Work;
(b) The Chairman of the Committee shall be the Executive Member for Social Work;
(c) 3 Members of the Committee shall constitute a quorum;
(d) The following function shall stand referred to the Committee:-
The consideration and determination of appeals by individuals who are the subject of information held on manually maintained Social Work records by the Council as Social Work Authority and who are aggrieved by any decision of that Authority concerning their access to, or rectification or erasure of, that information.
