Legal Services - Conveyancing
The conveyancing team within legal services provides a wide range of support and advice to Scottish Borders Council and is responsible for:
Domestic and Commercial Conveyancing
The Conveyancing Team prepares leases and other associated documentation for Council owned industrial sites and other commercial premises. The Team also prepare or revise Dispositions, Feu Dispositions, Leases and Excambions in respect of other property being bought or disposed by the Council.
The Conveyancing Team cannot provide legal advice to the public. Please contact your own solicitor or the Citizens Advice Bureau if you require legal advice. The Law Society will be able to provide you with a list of solicitors in the area if you need one.
Compulsory Purchase Orders
The Conveyancing Team prepares the documentation required in connection with the use of any of the Council's statutory powers to acquire land and buildings compulsorily.
Tree Preservation Orders
The Conveyancing Team prepares the documentation required to protect endangered trees.
Wayleaves
The Conveyancing Team prepares documentation necessary for the granting of wayleaves over Council owned land to telecommunication
and energy companies and public utilities.
Charging Orders
The Conveyancing Team prepares documentation on behalf of the Social Work Service required in connection with the Council's statutory powers to recover care home fees.
Planning Appeals Enforcement Notices
Our Team provide legal advice, expertise and representation in relation to both planning appeals and enforcement of planning control. This includes representing the Council as Planning Authority at public inquiries and making written submissions to the Scottish Executive where a planning decision of the Council has been appealed and drafting and serving a wide variety of enforcement notices to ensure that where there has been a breach of planning control, the situation is rectified.
